According to the lawsuit, throughout the Class Period defendants made false and/or misleading statements and/or failed to disclose that: (1) Cemex executives had engaged in an unlawful bribery scheme in connection with Cemex’s business dealings in Colombia; (2) discovery of the foregoing conduct would likely subject Cemex to heightened regulatory scrutiny and potential criminal sanctions; (3) Cemex lacked adequate internal controls over financial reporting; and (4) as a result, Cemex’s public statements were materially false and misleading at all relevant times. When the true details entered the market, the lawsuit claims that investors suffered damages.
