Nyrstar NV: arrest van het Marktenhof inzake de beslissing van de Sanctiecommissie van de FSMA

19 maart 2026 om 08.30uur CET

Zoals uiteengezet in het persbericht van 26 oktober 2025 (), hebben enkele aandeelhouders van de Vennootschap op 24 oktober 2025 een verzoekschrift neergelegd bij het Marktenhof houdende beroep tegen de beslissing van de Sanctiecommissie van 26 september 2026. Zij hebben daarbij de Vennootschap en de bestuurders die op 30 oktober 2018 in functie waren betrokken in het geding.

In hun verzoekschrift vroegen de eisende aandeelhouders onder meer dat het Marktenhof de beslissing van de Sanctiecommissie zou vernietigen, bijkomende inbreuken zou vaststellen en sancties zou opleggen.

Bij arrest van 18 maart 2026 heeft het Marktenhof zich zonder rechtsmacht verklaard om kennis te nemen van het ingestelde beroep van de eisende aandeelhouders.

Nyrstar begrijpt dat (een deels geanonimiseerde versie van) dit arrest zal worden gepubliceerd op de website van de FSMA.
