Can Carr Really Take Away ABC’s Licenses?
Yesterday, the FCC issued an order “calling in Disney’s ABC licenses for early renewal, at this time, under the Communications Act’s public interest standard.” The stated purpose is to investigate whether ABC has violated “the agency’s prohibition on unlawful discrimination” and to enable “the FCC to ensure that the broadcaster has been meeting its public interest obligations more broadly.” This comes just after President Trump has called on ABC to fire Jimmy Kimmel. In this note, we address whether the FCC can take away ABC’s licenses and what the implications are for broadcasters and other media platforms of Carr’s action.
