Can the FCC Rate Regulate Network/Affiliate and vMVPD Relations?
FCC Commissioner Simington co-authored an op-ed—endorsed by President Trump—calling on the FCC to intervene on behalf of local broadcast affiliates in their negotiations with national networks and Virtual Multi-channel Video Programming Distribution platforms (vMVPD), including by limiting the amount local affiliates pay the national networks to obtain the national network programming. In this note we describe the proposal, the legal authority, the politics at the FCC, and where, and if so, how, such government intervention could take place.
