NSR Policy Quick Take: 2nd Circuit Upholds New York Law Requiring Low-Income Broadband Offering

What's new: The Second Circuit has upheld the New York law requiring ISPs to offer a low cost offering to low-income customers. We think this decision, which is negative for ISPs, was likely timed to the FCC decision on Title II and paints a path that other states will look at as the Affordable Connectivity Program (ACP) runs out of funds.
