NSR Tech Policy: Section 230 Protections for Social Media Platforms Suffer Major Setback
In a case with potentially severe consequences for the current social media business models, the 3rd Circuit Court of Appeals held that TikTok could be liable for the death of a ten year old who committed suicide after viewing a TikTok challenge recommending recording oneself in acts of self-asphyxiation. The court denied TikTok’s Section 230 defense on the grounds that the that law’s immunity did not shield the company from its algorithmic promotion of user content, something that every social media company does.
